Terms of the agreement
This is a translation for information. In case of any discrepancy, the Azerbaijani text of the agreement prevails.
I. Under the laws of the Republic of Azerbaijan you are responsible for the accuracy of the information entered in this registration form.
II. After you are informed that your request has been accepted, you must make the payment within 3 (three) working days at the latest. Otherwise your request will be cancelled unilaterally.

1. SUBJECT OF THE AGREEMENT
1.1. Under this agreement the PROVIDER undertakes to provide disk space on its servers and a control panel for hosting websites, e-mail and databases according to the plan chosen by the SUBSCRIBER (the “Hosting Service”), and the SUBSCRIBER undertakes to pay for this service on the terms of this agreement.
1.2. The features included in the Hosting Service (disk space, e-mail and FTP accounts, databases, SSL certificate, backups, etc.) are defined by the description of the chosen plan published on “buludtelecom.com”.
2. PRICE AND PAYMENT PERIOD
2.1. The price is defined by the chosen plan and payment period (1, 3, 6 months or 1 year) according to the prices published on “buludtelecom.com”.
2.2. The service is provided on a prepaid basis. After the paid period ends, the service continues only if the next period is paid.
3. RIGHTS AND OBLIGATIONS OF THE PARTIES
3.1. The PROVIDER shall:
3.1.1. Activate the hosting account within 1 (one) working day after receiving the payment and send the login details to the SUBSCRIBER’s e-mail address.
3.1.2. Ensure uninterrupted operation of the servers, except for the time needed for maintenance and troubleshooting, and inform the SUBSCRIBER in advance about planned maintenance.

3.1.4. Make regular backups of the data in the hosting account.
3.1.5. Not disclose information about the SUBSCRIBER or the data in the hosting account to third parties, except as provided by this agreement and the laws of the Republic of Azerbaijan.
3.2. The PROVIDER may:
3.2.1. Suspend the service without notice to protect the server and other subscribers if the SUBSCRIBER violates clause 3.4.
3.2.2. Limit resource usage (CPU, memory, disk operations) if the SUBSCRIBER’s website interferes with the normal operation of the server, and offer a more suitable plan.
3.3. The SUBSCRIBER shall:
3.3.1. Pay for the service in the manner and within the time set by this agreement.
3.3.2. Keep the login details (username, password) confidential and be responsible for the consequences of sharing them with third parties.
3.3.3. Keep the software used on the website (CMS, plugins, scripts) up to date and keep its own backup of its data.
3.3.4. Inform the PROVIDER within 10 (ten) days if its e-mail address or contact number changes.
3.4. Prohibited use: the SUBSCRIBER must not use the hosting account to:
3.4.1. Send spam (unsolicited bulk e-mail);
3.4.2. Host or distribute viruses, malware or phishing pages;
3.4.3. Publish content that violates the laws of the Republic of Azerbaijan or the copyright and other rights of third parties;
3.4.4. Attempt unauthorised access to other networks or servers, carry out attacks or scan networks.
4. PAYMENT TERMS
4.1. The SUBSCRIBER must pay for the next period before the paid period ends.
4.2. If payment is not made on time, the service is suspended. After suspension the account data is kept for 15 (fifteen) days; if payment is made within this time the service is restored, otherwise the data is deleted.
4.3. The SUBSCRIBER may move to a larger plan at any time by paying the price difference for the remaining period.
5. LIABILITY
5.1. The PROVIDER is not responsible for the content and legality of the data placed by the SUBSCRIBER in the hosting account; the SUBSCRIBER is responsible for this data.
5.2. The PROVIDER is not liable for lost profits, loss of customers or reputation resulting from the use of, or inability to use, the service.
5.3. As the Internet is a combination of different networks, the PROVIDER is not liable for networks and equipment outside its area of responsibility.
5.4. The SUBSCRIBER is liable for damage caused to the PROVIDER or third parties by violating clause 3.4.
6. FORCE MAJEURE
6.1. The parties are not liable for failure to perform their obligations due to force majeure (natural disasters, military operations, epidemics, failures in power supply or in the networks of connecting providers, prohibitive measures of state authorities, etc.).
6.2. If such circumstances last for more than 1 (one) month, the parties negotiate to find alternative ways of performing the agreement.
7. DISPUTE RESOLUTION
7.1. This agreement is governed by and interpreted in accordance with the laws of the Republic of Azerbaijan.
7.2. Disputes are first resolved through negotiations. If they cannot be resolved by negotiation, the parties apply to the competent court of the Republic of Azerbaijan.
8. TERMINATION
8.1. The SUBSCRIBER may terminate the agreement at any time by written request; the service then continues until the end of the paid period.
8.2. Termination does not release the SUBSCRIBER from paying any outstanding debt.
8.3. Before termination the SUBSCRIBER should copy its data. After the service ends, the data is deleted after the period stated in clause 4.2.
9. FINAL PROVISIONS
9.1. The PROVIDER may change the terms and prices in line with its tariff policy by publishing them on “buludtelecom.com” and notifying the SUBSCRIBER by e-mail 10 (ten) working days in advance. The price of an already paid period does not change.
9.2. From the moment this agreement enters into force, all previous correspondence and oral agreements between the parties on this subject become invalid.
9.3. This agreement is drawn up in Azerbaijani.
